OSHA 1926 Regulations for the Construction Industry.

 

 

 

I am in General Industry.  Is it possible that I can be also covered by the OSHA Construction Industry Standards?

General Industry 1910 vs. Construction Industry 1926

Yes, you may think that you are only covered by OSHA General Industry 1910, when you really might also be covered by OSHA's construction standard?  OSHA can cite you under the Construction 1926 standard when your maintenance requires penetrating the substrate of the structure. 

Here are a couple of examples.

Example 1:  An industrial operation re-paints their white walls in the factory that have yellowed.  No sanding or scrapping is performed.  The company's maintenance worker simply rolls new white paint on to the wall.  This employer would be covered under General Industry 1910.

Example 2:  An industrial operation re-paints their white walls in the factory that have yellowed.  However, the old paint is peeling.  The maintenance worker wants the new paint job to look good; consequently, the worker scraps the peeling paint off and sands the rough areas before rolling on the new white paint.  The employer is now covered by OSHA's construction standards in 1926 and the General Industry Standard in 1910.

This example came straight from the OSHA Area Director in Dallas, Texas while visiting A&M's Texas Engineering Extension Service office in June of 2004.

Why Computer Based Training (CBT) and Internet training does not work.

  4. Most people who look at these downloaded programs, soon realize that they will spend more time trying to change the program than if they had started with nothing.

  5. Many times you will wind up having things in the written program that you have no idea why the topic is there, yet you are afraid to remove it in fear that you may get in trouble if you remove the item.

  6. If you cannot explain why you have every sentence in a written plan, the plan is ineffective.  If you do not know the material completely, how can you expect someone else in the company to be able to utilize the plan as a true reference manual about proper procedures for your company?

Why do many salaried "Safety Coordinators" fail?       

  1. The become side tracked by duties not related to "safety".
  2. Business owners resent paying for full-time "Safety Coordinators"; therefore, the safety person is assigned more tasks not related to safety.
  3. The safety person becomes "blinded" by seeing the operation everyday while working on other tasks.  This means that the safety person is overlooking what is obvious to an outsider.
  4. Many in-house safety people, have not been properly trained through formal safety education or continuing education.
  5. Often, the safety program is assigned to someone who may be competent; however, they have other tasks that they were trained for and cannot keep up to date on both jobs.
  6. Many small or growing businesses assigned the payroll clerk or someone in the accounting department to be the safety person.  Normally, this person finds just enough time to turn in an accident claim to the workers' compensation carrier.
